A Colorado man - who had just killed a home intruder moments before - was fatally shot by police after he was mistaken for a burglar. The homeowner was taken to a hospital with gunshot wounds where he later died.

An officer shot and killed him, but when police went inside the home they found the intruder dead on the bathroom floor, shot minutes prior by Black. Around 1:30am, multiple 911 calls came in about a disturbance, including one call from an adult female who said an adult male was breaking into her home, the Aurora PD says in a press release.

Authorities also found an injured juvenile, who was taken to the hospital for "serious, but non-life-threatening injuries".

According to Mohamedbhai, the intruder broke into the Blacks' home, yanked his 11-year-old grandson off a couch where was sleeping and started choking him in a bathtub.

The identities of the homeowner and the intruder have not been released. Both he and Black were trying to save the boy.

"Gary was shot and killed by police while he was in his living room". Black's wife had called the police and ran outside.

According to the lawyer, Black left the Army and became a federal agent.
