In his Senate testimony last month in which he denied allegations that he sexually assaulted a woman in high school, accusing Democrats of orchestrating a partisan campaign against him, Kavanaugh had promised that, if he was confirmed, the four clerks working for him would be women.

Brett Kavanaugh endured a Supreme Court confirmation ordeal like no other.

Kavanaugh jumped in, asking a series of questions during the proceedings. So why don't we follow what Curtis Johnson seemed to do in applying those general statements to the specific statute at issue here and why wouldn't that then encompass the Florida statute, which requires more than, say, a tap on the shoulder?

Kavanaugh's nomination was thrown into jeopardy when university research psychologist Christine Blasey Ford came forward with accusations that he had sexually assaulted her when they were teens in the Washington area. Two other women accused Kavanaugh of sexual misconduct dating to the 1980s.

Before hearing arguments on Tuesday, the justices turned aside appeals of a 2017 ruling authored by Kavanaugh on the lower court that struck down a 2015 environmental rule imposed under former President Barack Obama regulating a potent greenhouse gas linked to climate change.

The appeals were brought by an environmental group and companies that supported the rule, which had limited hydrofluorocarbons used in a variety of products including spray cans and air conditioners.

During Kavanaugh's confirmation process, dozens of women had dressed up in similar costumes to represent the TV show's depiction of women living under a dystopian fundamentalist regime.

On Monday evening Kavanaugh, 53, joined family members, friends and President Trump at the White House for a ceremonial swearing-in ceremony, where the new justice tried to ease the partisan wounds from his confirmation process. The FBI probe into the allegations against Kavanaugh reportedly found no corroboration of the allegations against him but was criticized by Democrats for not being a full investigation. One of the two cases the court is hearing Wednesday involves the detention of immigrants, an issue on which Kavanaugh's vote could be key.

His views on presidential powers could be tested within days in a dispute over whether Commerce Secretary Wilbur Ross should submit to questioning by lawyers suing the Trump administration over a decision to add a controversial citizenship question to the 2020 census.
